Service Agreement

This agreement is valid for all services provided through our website. Individuals or legal entities placing orders must read the entire agreement before ordering. This agreement consists of the terms of use and rules for the services provided by Hosting Dünyam Information Technologies Trade Limited Company. If you do not accept the agreement, please stop the ordering process immediately. All customers who have placed orders or made payments will be considered to have accepted this agreement. Our agreements are fully available to you during registration and through our website.

  1. Service Provider and Parties

    1.1: This agreement is between Galaksi Hosting Information Technologies (referred to as "Galaksi Hosting") providing the services specified in the services section, and the person/institution (referred to as "Customer") specified in the new customer registration section on the internet site operated by Galaksi Hosting under the terms and conditions stated below.

    1.2: The parties hereby declare, accept, and undertake the accuracy of the information written in this agreement.

  2. Subject of the Agreement

    2.1: This agreement regulates the services that the customer will choose and the fees to be paid to Galaksi Hosting in exchange for these services, based on the information provided during registration and transactions on the site.

    2.2: Membership information is the data entered by the customer at the time of membership. These details are assumed to be accurate and will be the basis for transactions.

  3. Responsibilities of the Agreement

    3.1: Galaksi Hosting Internet Services will provide the services ordered by the customer. Upon acceptance of the order, Galaksi Hosting will commit to providing the specified service after collecting the appropriate fees.

    3.2: Payment methods and VAT differences will be specified during the order process, indicating the total amount due, and the fees due will be communicated by Galaksi Hosting based on the customer's monthly or annual payment preferences.

    3.3: After the order is confirmed, Hosting Dünyam will provide the customer with control panel, FTP, SQL, and email usernames and passwords related to the service specified in the customer's order detail. The customer is responsible for these accounts and passwords, and any damages arising from their use.

    3.4: The customer undertakes to comply with all declarations and warnings given by Hosting Dünyam as part of the service received.

    3.5: The customer undertakes not to access unauthorized files or programs and agrees to compensate for any damages that may arise from such issues.

    3.6: The customer undertakes the responsibility for any taxes, duties, and similar obligations that are effective or will become effective during the service period.

    3.7: The customer is responsible for all files, documents, and programs hosted within the service, and all legal and criminal responsibilities arising from any unlawful data or information.

    3.8: Galaksi Hosting is not liable for any material or moral damages arising from the misuse of customer data within the service, nor for data backup and storage obligations, which are the responsibility of the customer.

    3.9: Galaksi Hosting will conduct domain name registration processes for orders that have been successfully paid for by the customer. The customer owns the domain name once it is registered and paid for.

    3.10: If the customer engages in defaming or negatively criticizing the company, their account will be terminated without any responsibility on the part of the company.

    3.11: The customer is responsible for paying the shipping costs if they request an invoice to be sent; if they refuse to pay shipping costs, these will be billed to their account.

    3.12: The customer cannot hold the company responsible for software issues not caused by the company. Server services are provided as unmanaged, and all responsibilities lie with the customer.

    3.13: The customer will receive the ordered service within 48 hours after payment. If the service is not delivered within this timeframe, the customer can request a refund.

  4. Delivery Time of the Agreement and Services

    4.1: This agreement takes effect when the order and payment processes are transmitted to Galaksi Hosting through the internet.

    4.2: The duration of the agreement is as long as the payment period selected by the customer during the order.

    4.3: If the parties do not notify each other 10 business days before the end of the contract that it will terminate, the contract will automatically renew under the same terms and conditions.

    4.4: Hosting and reseller accounts are activated automatically after payment confirmation. VDS, Dedicated server services require specific setup times and are delivered within specified durations.

  5. Cost Details of the Agreement

    5.1: The fee payable for the services specified in this agreement is as stated during the order process. If VAT is not included in the stated price, it will be calculated and added later.

    5.2: Galaksi Hosting reserves the right to change prices and tariffs without prior notice. The customer accepts any future changes by agreeing to this agreement.

    5.3: If the fee is given in a foreign currency, it will be converted to Turkish Lira based on the effective selling rate of the Central Bank on the invoice date.

    5.4: The payment must be made by the end of the 5th business day after the invoice date, either by credit card if authorized during the order process, or by payment to the bank account details provided at the customer contact address, or directly to Galaksi Hosting.

    5.5: Galaksi Hosting reserves the right to issue an exchange rate difference invoice if the payment is delayed.

    5.6: Galaksi Hosting reserves the right to suspend the service until the customer completes the payment.

    5.7: Refunds are not available for domain names, SSL certificates, and server services (colocation, dedicated, virtual servers) as specified during the order process.

  6. Suspension of Services and Accounts

    6.1: If there are payment issues, or if customers with credit card payment instructions face transaction issues, Galaksi Hosting reserves the right to suspend all services provided to the customer, including email, web, and FTP accounts.

    6.2: During this suspension, access to email, web, and FTP for the customer will be blocked, and incoming emails will be rejected.

    6.3: On our servers, the maximum CPU and RAM usage per site is 20%. Accounts exceeding this limit will be suspended after the first warning. Specific CPU usage limits stated in special campaigns or packages apply. If internet sites or services exceed these CPU limits, Galaksi Hosting reserves the right to shut down or cancel the service without notifying the customer if it becomes a problem.

    6.4: It is forbidden to store content that infringes copyright or violates laws of the Republic of Turkey on our servers. This includes content related to brute force, spam, DDoS, hacking, cracking, warez, adult content, and any copyrighted files.

    6.5: The security of all software on the server is the responsibility of the customers. Galaksi Hosting is not liable for any issues arising from settings like Chmod 777 or software-related vulnerabilities.

    6.6: If the customer does not pay the invoice by the specified due date, the service will be suspended for 1 to 3 days. Galaksi Hosting is not responsible for any consequences that occur after the 1st or 3rd day. The customer must follow the payment cycle and make payments without delay.

    6.7: It is prohibited to conduct DDoS attacks from our servers. If such an incident is detected, Galaksi Hosting reserves the right to cancel the service without consulting the customer.

    6.8: Systems that are forbidden to be hosted on our services will result in unconditional and immediate suspension of the service if detected. Refunds are not provided for suspended services.

  7. Termination of the Agreement

    7.1: If the customer fails to fulfill their responsibilities and commitments under this agreement or if it is discovered that the information provided at the front of the agreement is incorrect, or if the suspension status mentioned above continues for more than 3 days, Galaksi Hosting has the right to terminate the agreement unilaterally without any notice or warning. In such a case, the customer cannot demand a refund for the remaining period and agrees to pay a contractual penalty equal to five times the contract fee effective at the date of termination.

    7.2: The customer has the right to terminate the agreement by giving a written notice at least 10 days before the end of the normal duration of the agreement. If the customer terminates the agreement before the end date, they agree to pay half of the fees due for the remaining period of the contract immediately and in advance.

  8. Communication and Information Addresses

    8.1: Both parties accept the postal addresses specified at the time of order as their legal residences for any notifications arising from this agreement.

    8.2: Notifications to these addresses are considered delivered even if they do not reach the parties physically. Changes to these addresses are not valid unless communicated in writing to the other party.

    8.3: Galaksi Hosting may send messages, information, notices, payment notifications, account movement charts, and account statements to the customer's stated email address during the contract period. The customer cannot claim that these electronic messages were not received and acknowledges that they are legally notified one day after the messages are sent.

  9. Doubts in Payment of the Fee

    9.1: If the customer does not make the payment within 7 days following the application date, they are considered to be in default. In this case, Galaksi Hosting may issue an exchange rate difference invoice and may demand a monthly late payment fee of 25%. The customer agrees to pay this late payment fee and the exchange rate difference invoice.

    9.2: The customer agrees to pay a monthly late payment fee of 25%, a contractual penalty of 50% of the remaining debt amount, 10% attorney fees, and all other legal expenses if Galaksi Hosting initiates a lawsuit or execution proceedings for any claims arising from this agreement.

    9.3: If the customer applies for Precautionary Attachment or Precautionary Measure for the collection of receivables arising from this agreement, Galaksi Hosting is authorized to obtain an unsecured Precautionary Attachment and Precautionary Measure decision. However, if the courts require a guarantee, the customer agrees to pay the commission and all fees arising from bank guarantee letters and will not object to these charges.

    9.4: If the payment for the purchased service is not made on time, Galaksi Hosting has the right to suspend the service without notice; if the fee is not paid within one week after the payment due date, Galaksi Hosting also has the right to irreversibly delete the service. Customers subjected to this procedure agree not to request backups or service activation.

  10. Hosting Service Use Conditions

10.1: In hosting servers (shared servers), each customer has the right to use up to 25% of the CPU to ensure equal rights for everyone. Websites or services that exceed this capacity may be suspended with or without warning. Galaksi Hosting is not liable for any damages arising from this.

10.2: Galaksi Hosting is not obligated to provide any information or transmission for suspended sites or services. All customers are considered to have read and accepted the terms of the agreement in advance.

10.3: Use of hosting servers for mailing services is prohibited. Mail services can be used individually, but corporate mail sending is not supported. Galaksi Hosting may suspend a site in this situation. Mail services are not suitable for mass mailing.

10.4: Use of the hosting server for archiving is prohibited. In this context, Galaksi Hosting automatically deletes all files over 10 MB from the servers.

10.5: Backups taken from control panels in hosting services do not constitute actual backups. These backups should be downloaded to your local computer or device. In the event of data loss, backups not downloaded from the control panel will not be functional. Galaksi Hosting performs backups to remote servers at regular intervals. Even in this scenario, Galaksi Hosting does not guarantee data recovery. The responsibility for taking backups lies with the customer.

10.6: In hosting services, the "disk is not limited" statement applies only to site files. Use of file extensions such as tar.gz, jpeg, png, mp3, mp4, avi, pdf, etc., for disk usage is prohibited. If this occurs, your site may be suspended.

10.7: In hosting services, the transmission of backups for sites that are past due or suspended due to a violation is solely at the discretion of Galaksi Hosting. Galaksi Hosting may charge an additional fee for backup transmission or may refuse to transmit backups. Customers should consider their responsibility for taking backups in this situation.

10.8: Enabling or loading banned PHP functions in hosting services can only be processed after inspection by Galaksi Hosting and the Galaksi Hosting server team. Galaksi Hosting may refuse this additional condition.

  1. VDS – Dedicated – Game Server Service Use Conditions

11.1: In VDS and Game Server servers (shared servers), each customer has the right to use up to 50% CPU to ensure equal rights for everyone. Servers or services exceeding the specified usage limits may be suspended with or without warning. Galaksi Hosting is not liable for any damages arising from this.

11.2: After purchasing VDS and Game Server services, customers should be aware that these are shared services. In this service, where everyone has equal rights, Internet (Network) usage cannot exceed 100Mbit/s. Servers or services exceeding these usage limits may be suspended with or without warning. Galaksi Hosting is not liable for any damages that may occur.

11.3: In VDS, Game Server, and Dedicated servers, IP addresses used may be subject to announcement suspension if SPAM or ABUSE reports are received. If such actions put the IP address at risk or on spam lists, Galaksi Hosting will automatically suspend the service. Notification is solely at the discretion of Galaksi Hosting. If there is any spam issue or IP-based access problem with your IP address, please inform Galaksi Hosting within 2 hours after the order through the Technical Support area on the system.

11.4: When VDS Server services are purchased, Galaksi Hosting is only responsible for ensuring that the server is active and receiving connections. The activation or functionality of installations such as web pages, MySQL, DNS, SSL, apache2, squid Proxy, etc., inside the server is not the responsibility of Galaksi Hosting. If the customer wants these types of packages to be inspected, installed, or activated, they can purchase an SLA (Support) package from our systems. The acceptance or rejection of the support package is solely at the discretion of Galaksi Hosting.

11.5: In VDS, Game Server, and Dedicated server services, which are shared servers, Galaksi Hosting does not take responsibility for backup or file retention. The responsibility for taking backups in these services lies with the customer. Customers can opt for our Backup services if desired. Backups for customers who avail of our Backup services are stored on remote servers.

11.6: Customers who avail of the Backup service are not liable for any data loss or inability to access data. Customers should perform backups to their local devices.

  1. Refund Conditions

12.1: For refund requests accepted by Galaksi Hosting, if the customer cannot issue a refund invoice, a deduction equal to the VAT rate will be made, and the remaining amount will be refunded after deducting the bank transfer/EFT fee.

12.2: Customers cannot request a refund for credits loaded onto the system or for payments made for the purpose of extending the service for the following month/year.

12.3: Only Hosting services offered from Turkey locations are eligible for a refund within 72 hours (3 days). Refunds are processed during this period, and no refund requests are accepted thereafter.

12.4: Customers cannot request refunds for domain names, servers, software, licenses, and other services. Detailed refund conditions are explicitly stated in our Refund Agreement.

12.5: Upon a refund request, Galaksi Hosting reserves the right to process the request at the earliest in 5 days and at the latest within 1 month, depending on the company's decision at that time.

12.6: Absolutely no refunds are made for promotional products. Services purchased under a promotion are considered promotional items without expecting a discount or monetary compensation for other services.

12.7: Our company reserves the right to stop, change, or alter the prices of campaigns without notifying the customer.

  1. Failure Conditions

13.1: Since servers are electronic devices, they carry inherent risks of failure, no matter how optimal the conditions are. Spare parts for malfunctioning servers are provided by the data center.

13.2: Our company is not responsible for any damages arising from the supply time of faulty parts and spare parts. The person receiving the service cannot claim any rights from the company during this period and must wait until the new or faulty part is supplied.

13.3: Recovery is not possible for disks that become unrecoverable due to errors from Raid configurations. In such cases, Raid is reconfigured, and if backups are available, they are loaded. Our company is not responsible for Raid configuration and software errors.

13.4: In server services that include managed services, our company does not accept liability for any data loss or damages experienced.

13.5: In server services, our company is not responsible if servers go offline during data center or IP changes. The activation time for devices during transfers is at least 2 and at most 5 business days.

  1. Authorized Courts and Execution Offices

14.1: This agreement consists of 14 articles and subheadings, read and understood by the parties before being signed. (Signing takes place when the order is sent to Galaksi Hosting through the internet). Galaksi Hosting reserves the right to add new articles and/or subheadings, remove or change articles. The customer hereby accepts these changes in advance.

14.2: Additional invoices may be issued due to changes in the inflation rate within the year for customers receiving annual services.

14.3: Only the Courts and Execution Offices of Istanbul are authorized to resolve any disputes arising during the implementation of this agreement.
